Terms & conditions

DEFINITIONS

1. In these conditions: 

a) The “Owner” is Aeternum Event Creations Pty Ltd, trading as Aeternum Event Creations.  

b) The “Hirer” refers to the person, group or organisation hiring equipment from the Owner. 

c) The “Equipment” means all the equipment and accessories supplied to the Hirer and set out specifically in the relevant tax invoice supplied. 

d) The “Bond” means the amount of money to be paid prior to hiring of the Equipment to cover loss, damaged or repairs as a consequence of the hire.  

e) The “Deposit” means a non-refundable 50% deposit for the securing of the Equipment hire.  

f) The “Full Payment” means the total hire amount including the bond less the deposit to be paid on the collection of the Equipment.   

FEES and CHARGES

2. The Owner will provide the Hirer with a booking confirmation and tax invoice setting out the hire costs.  

3. A 50% Deposit is required at time of booking. No order is secure until the full Deposit is paid. The Full Payment, including the Bond minus the Deposit, must be made at least of 48 hours prior to delivery and/or pick-up of Equipment.  

4. The price is quoted in Australian Dollars (AUD) and is exclusive of Goods and Service Tax (GST).  

5. The cost quoted is for one use of the Equipment only – for the hiring period noted on the tax invoice.   

6. The Hirer agrees that all charges for hire loss, hire extension, damage and repair will be paid and that all collection fees, legal fees or any expenses involved in the collection of these charges will be accepted by the Hirer.   

7. The prices quoted are for delivery on street level. Extra charges will be payable for delivery to and collection from higher or lower levels. Any additional cost incurred by venues the Owner for delivery of Equipment will be passed onto the Hirer.    

8. Prices quoted do not include Additional Services including but not limited to site inspections, furniture removal or relocation, storage, or onsite styling. Additional Services are available upon request and incur additional charges.   

9. A late fee of $40 per hire will be charged on Equipment which is not returned in accordance with the hire term. The sum of $40 per day will be charged thereafter.  

CANCELLATION POLICY   

10. Cancellation of orders by the Hirer will forfeit all booking deposits made unless the Hirer notifies the Owner in writing at least 7 days prior to delivery and/or pick-up of Equipment.  

a) Cancellations that are made more than 7 days from day of pick-up/delivery will receive a full refund. 

b) Cancellations made less than 7 days from the day of delivery but more than 48 hours from the day of delivery will receive a refund for the delivery and collection fees only. The deposit is considered as cost of lost opportunity and is not refundable. 

c) There is no refund for customer Equipment collections cancelled less than 7 days from the day of collection. 

d) There is no refund applied for equipment cancelled within 48 hours from the day of delivery.  

COVID POLICY

11. In the event of Government mandated lockdown or imposed restrictions around Covid-19:   

a) If the COVID-19 mandate or lockdown which affects your event, is more than 24 hours before the date of your delivery, we will work with you to move your event to another date at no additional cost. 

b) If the COVID-19 mandate or lockdown which affects your event, is less than 24 hours before the date of your delivery, we will work with you to move your event to another date, however there will be charge of an additional delivery fee in the sum of $X to allow for the expenses already exhausted on planning, administration, and labour. 

c) In the event of cancellation not related to a COVID mandate or lockdown, please refer to our cancellation policy in section 9.   

LIABILITY and INSURANCE   

12. The Hirer is responsible for the Equipment from the time of delivery until collection by the Owner and shall pay for all Equipment damage or lost, however caused during that period. The Owner shall protect the Equipment from the elements during the time of delivery, use, storage or waiting period before delivery. The Owner shall not be liable for any loss or damage caused to any person, property, animal or things whatsoever arising from the use of the Equipment hereby hired and the Hirer compensates the Owner in respect to any claims for such loss or damage.   

13. The Owner will assess and document the condition of the Equipment prior to pick-up/delivery and on its return. Once the Owner is satisfied that the Equipment is in the same condition in which it was leased, the Owner will arrange for the Bond to be returned to the Hirer’s nominated bank account within 2 business days from the date of the Equipment return. Any damages, losses, breakage will reduce the Bond refund. All reductions to the Bond amount will be documented to the Hirer for clarification.  

14. The Hirer shall not remove the Hire Equipment or any part thereof from the location and position of its installation by the Owner without consent from the Owner. The Hirer grants the Owner access to inspect or repair the Equipment and in the case of default to remove the Equipment. The Hirer shall on no account attempt to repair the Equipment but notify the Owner immediately in case of breakdown or failure.  

15. The Hirer acknowledges that he has received adequate instruction on the correct use of the Equipment, which includes demonstration or verbal or written instructions.   

16. The Hirer agrees not to use the Equipment at locations or purposes different to the Equipment’s general designated purpose and specified suitability, such as indoor vs. outdoor use. The Hirer acknowledges responsibility for the Equipment and is liable for any damage.  

17. In the event of any loss or damage pursuant to Clauses 11 to 15, the Owner will determine the cost of the relevant breakage, damage or loss, and the Hirer’s bond will be reduced by that cost. If the cost exceeds the Bond being held, the Hirer agrees to pay the Owner the sum which exceeds the Bond.   

18. The person signing the hire documents for and on behalf of the Hirer hereby agrees with the Owner that he or she has the authority of the Hirer to make this agreement on the Hirer’s behalf and is empowered by the Hirer to bind the Hirer to this agreements and hereby indemnifies the Owner against all losses and cost incurred by the Owner arising out of the person signing this agreement failing to have such power and/or authority.  

19. Where the Hirer is more than one person, liability shall be joint and several.  

20. By making a booking through confirming a quote via signature, deposit payment or transfer of funds, the Hirer acknowledges and agrees to the Owner’s Terms and Conditions.  

21. The Owner reserves the right to take photos at event locations utilising the Owner’s equipment. Photos are taken with a focus on the Equipment and are selected with due care to exclude recognisable private property and persons. Photos may be used in publications or other media material produced, used, or contracted by the Owner.
